Terms of Service & Software License

These Terms of Service and Software License (“Terms”) govern your access to and use of BIMSheets, including the BIMSheets software plugin for Autodesk Revit, the BIMSheets website, licensing services, subscriptions, updates and related services (collectively, the “Service”).
By downloading, installing, activating, accessing or using BIMSheets, you agree to these Terms.
If you do not agree to these Terms, do not install or use BIMSheets.


1. Provider and Ownership

BIMSheets is developed by Lubomir Georgiev, who owns the intellectual property rights in the BIMSheets software and related materials, except for third-party materials and rights expressly identified otherwise.

Nothing in these Terms transfers ownership of the BIMSheets software or its intellectual property rights to you.


2. What BIMSheets Is

BIMSheets is a software plugin for Autodesk Revit designed to assist with sheet creation and management, view placement, title blocks, legends, schedules, replacement of elements, sizing and related BIM documentation workflows.
BIMSheets operates primarily on the user’s local computer and within the user’s Autodesk Revit environment.
BIMSheets does not require the user’s Revit project files or BIM model data to be uploaded to BIMSheets servers in order to perform its core BIM functions.


3. License Grant
Subject to these Terms and successful activation, we grant you a limited, non-exclusive, non-transferable and revocable license to install and use BIMSheets for its intended purpose.
A BIMSheets license is assigned to one active computer at a time.
One license key may have one active device.
You may deactivate a device and activate the license on another computer, for example when replacing or changing a computer.
If a computer becomes unavailable or is permanently damaged, you may contact support at support@bimsheets.com to request deactivation of the previous device.
You may not sell, transfer, sublicense, rent, lease or otherwise distribute a BIMSheets license key without our written authorization.


4. Free Plan

BIMSheets may be available under a Free plan.
The Free plan may be used without providing an email address, subject to the functionality and limitations displayed on the BIMSheets website.
We may change the features or limitations of the Free plan in the future.
The Free plan does not create an obligation for us to provide any particular functionality indefinitely.


5. Trial

BIMSheets Pro may be offered with a 30-day free trial.
A payment card is not required to start the trial unless expressly stated otherwise during the purchase process.
The trial does not automatically convert into a paid subscription.
At the end of the trial period, the license may continue under the Free plan unless you purchase a Pro subscription.
We reserve the right to limit repeated or abusive use of promotional trials.


6. Pro Plans

BIMSheets Pro may be offered as:

• a monthly subscription; or

• an annual subscription.

The applicable price is displayed on the BIMSheets website or at checkout.
Current advertised prices may include:

• Pro Monthly: USD 25 per month;

• Pro Annual: USD 210 per year.

Prices, taxes and applicable charges will be presented during checkout where required.
We may change prices for future purchases or renewal periods. Changes to an existing subscription will be handled in accordance with applicable law and the terms presented at the time of purchase.


7. Payment

Payments are processed through third-party payment providers, including Stripe.
BIMSheets does not receive or store your full payment card number, card security code or other full payment-card credentials.
Your payment relationship may also be subject to the terms and policies of the relevant payment provider.
We may receive payment-related information necessary to provide the Service, including payment status, transaction identifiers, subscription identifiers, billing period and related metadata.


8. Subscription Renewal and Cancellation

Unless otherwise stated at checkout, Pro subscriptions renew automatically at the end of each billing period.
You may cancel a subscription at any time.
Cancellation prevents future renewal charges but does not normally terminate the already-paid subscription period.
If you have paid for one month, your Pro access remains available for that paid month.
If you have paid for one year, your Pro access remains available for that paid annual period.
Cancellation alone does not entitle you to a refund for unused time in the current billing period.


9. 14-Day Money-Back Guarantee

In addition to any mandatory rights you may have under applicable law, BIMSheets offers a voluntary 14-day money-back guarantee for Pro purchases.
You may request a refund within 14 days of the initial purchase of a Pro subscription.
If a refund is approved:

• the relevant payment will be refunded;

• the associated Pro license will be deactivated;

• continued use of Pro functionality will no longer be permitted.

The 14-day money-back guarantee applies to both monthly and annual Pro plans.
The guarantee does not limit or replace any mandatory consumer rights that apply to you under applicable law.
Where applicable law gives you a statutory right of withdrawal, conformity remedy, refund or other consumer protection, those rights remain unaffected.


10. Failed Payments

If a recurring payment fails, we may provide a grace period of up to 7 days to allow the payment issue to be resolved.
If payment remains unsuccessful after the applicable grace period, the Pro license may be suspended until the payment issue is resolved.
A suspended license is not necessarily terminated or deleted.
Once the applicable payment issue has been successfully resolved, the license may be reactivated.


11. License Activation and Offline Validation

BIMSheets uses license activation and device identification to enforce license limits and protect against unauthorized use.
The plugin may use a device identifier associated with the computer on which it is activated.
After a successful online license validation, BIMSheets may permit continued use while offline for up to 10 days.
The 10-day offline period is not cumulative.
Each successful online validation starts a new offline validation period.
If BIMSheets cannot successfully validate an applicable license after the permitted offline period, online validation may be required before continued use of the licensed functionality.


12. License Keys

License keys are personal to the customer or organization to which they are issued.
You are responsible for keeping your license keys reasonably confidential.
You must not publicly publish, resell, share or distribute license keys.
Where multiple licenses are purchased, each license may be assigned to a separate computer.
For example, purchasing ten licenses may result in ten separate license keys, allowing the customer to decide which ten computers use those licenses.


13. Software Updates

BIMSheets may periodically provide updates, bug fixes, security improvements, compatibility updates and new versions.
BIMSheets does not necessarily install updates automatically.
The user may be notified when an update is available and may choose whether to install it.
Before installation, BIMSheets may verify the authenticity and integrity of an update using software code signing and cryptographic file verification.
Updates may be required for continued compatibility with supported versions of Autodesk Revit or operating systems.
We do not guarantee that every version of BIMSheets will remain compatible with every future version of Autodesk Revit.


14. Local Processing and BIM Data

BIMSheets’ core BIM operations are performed locally on the user’s computer within Autodesk Revit.
This includes operations such as:

• creating and managing sheets;

• placing views;

• placing title blocks;

• placing legends;

• placing schedules;

• replacing elements;

• sizing and arranging elements;

• applying BIMSheets rules and drawing standards.

Your Revit project files and BIM model data are not intentionally uploaded to BIMSheets servers for these operations.
The BIMSheets online services are primarily used for functions such as licensing, subscription status, device activation, software update information and related technical services.


15. Acceptable Use

You may not:

• reverse engineer BIMSheets except to the extent such activity cannot legally be restricted;

• decompile or disassemble the software except where expressly permitted by applicable law;

• circumvent license activation or technical protection mechanisms;

• modify or tamper with licensing mechanisms;

• distribute unauthorized copies;

• share license keys;

• use the Service to develop or distribute unauthorized copies or substantially similar competing software;

• interfere with the operation or security of BIMSheets services;

• use automated methods to abuse or overload the licensing or update infrastructure.

Nothing in these Terms restricts rights that cannot legally be restricted under applicable law.


16. Intellectual Property

All rights, title and interest in BIMSheets, including its software code, architecture, interface, documentation, branding, graphics and other original materials, remain with their respective rights holders.
BIMSheets is not sold to you as a transfer of ownership.
You receive a license to use the software under these Terms.
Autodesk, Revit and related Autodesk trademarks and intellectual property are owned by Autodesk, Inc. or its respective rights holders.
BIMSheets is an independent third-party product and is not an Autodesk product unless expressly stated otherwise.


17. Third-Party Services

BIMSheets may rely on third-party services for functions such as payment processing, hosting, security, infrastructure, accounting, email delivery or software distribution.
Third-party services may have their own terms and privacy policies.
We are not responsible for failures caused exclusively by third-party services outside our reasonable control.


18. Availability and Support

We aim to keep BIMSheets services reasonably available and functional, but we do not guarantee uninterrupted or error-free operation.

We do not guarantee a specific response time.


19. Disclaimer

To the maximum extent permitted by applicable law, BIMSheets is provided on an “as is” and “as available” basis.
We do not guarantee that BIMSheets:

• will be completely error-free;

• will work with every Revit project;

• will remain compatible with every future version of Autodesk Revit;

• will satisfy every specific workflow or project requirement;

• will be continuously available without interruption.

BIMSheets is a productivity tool. You remain responsible for reviewing drawings, models, documentation and project outputs generated or modified using the software.
You are responsible for maintaining appropriate backups of your Revit projects and other important data.


20. Limitation of Liability

To the maximum extent permitted by applicable law, Tectonis EOOD and Lubomir Georgiev shall not be liable for indirect, incidental, special, consequential or punitive damages, loss of profits, loss of business, loss of data or business interruption arising from or related to the use of BIMSheets.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.
For paid subscriptions, and to the maximum extent permitted by applicable law, our aggregate liability arising from the Service shall not exceed the amount you paid for BIMSheets during the 12 months preceding the event giving rise to the claim.
Mandatory consumer protections remain unaffected.


21. Suspension and Termination

We may suspend or terminate a license where reasonably necessary because of:

• serious or repeated breach of these Terms;

• license-key abuse;

• unauthorized distribution;

• circumvention of technical protections;

• fraudulent activity;

• non-payment;

• conduct that materially threatens the security or operation of the Service.

Where reasonably possible, we will provide an opportunity to resolve the issue before termination.
Termination does not affect rights or obligations that by their nature should survive termination.


22. Changes to the Service

We may modify, improve, replace or discontinue parts of BIMSheets.
We may introduce new features, remove obsolete features or change plan limitations.
We will make reasonable efforts to avoid materially disrupting existing paid subscriptions.
Nothing in this section limits mandatory rights applicable to consumers.


23. Changes to These Terms

We may update these Terms from time to time.
The updated version will be published on the BIMSheets website with a new effective date.
If a change materially affects your rights or obligations, we will take reasonable steps to notify affected users where appropriate.
Your continued use of BIMSheets after the effective date of updated Terms constitutes acceptance of the updated Terms, to the extent permitted by applicable law.


24. Governing Law

These Terms are governed by the laws of the Republic of Bulgaria, without prejudice to mandatory consumer protection laws that may apply to consumers in their country of residence.
Nothing in these Terms deprives a consumer of mandatory rights available under applicable law.

26. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in effect to the extent permitted by law.


27. Entire Agreement

These Terms, together with any applicable purchase information and policies expressly incorporated into them, constitute the agreement between you and the provider regarding your use of BIMSheets, subject to mandatory rights under applicable law.
